Regulation and Compliance

How UQG Ltd is registered and supervised, and the rules we follow.

Regulation

We want you to know exactly who we are, who supervises us and which rules we follow. uQualify© is a trading name of UQG Ltd, a company registered in Cyprus (company registration number HE410562) with its registered address at Prodromou 121, Hadjikyriakeion Building, 1st floor, Strovolos, 2064, Nicosia, Cyprus.

AUSTRAC

AUSTRAC (the Australian Transaction Reports and Analysis Centre) is the Australian Government agency responsible for regulating businesses for anti-money laundering and counter-terrorism financing (AML/CTF), and is also Australia's financial intelligence unit. It supervises businesses under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

UQG Limited is regulated under AUSTRAC with account number 100857068. Under its AUSTRAC registrations, UQG Ltd provides regulated exchange and remittance services. It is registered as:

  • a remittance provider on AUSTRAC's Remittance Sector Register, which permits it to provide remittance (money transfer) services; and
  • a digital currency exchange provider (from 31 March 2026 described as a virtual asset service provider), which permits it to exchange digital assets for money and money for digital assets.

As a registered business we must run an AML/CTF programme, verify our customers' identity, monitor transactions, report suspicious matters and certain transactions to AUSTRAC, and keep records.

AUSTRAC registration is not a banking licence and does not mean that AUSTRAC endorses our services. uQualify accounts are not bank deposits and are not covered by the Australian Government's Financial Claims Scheme.

Switzerland: UQG GmbH and SRO membership

UQG GmbH (in Gründung, meaning "in formation") is a Swiss limited liability company (Gesellschaft mit beschränkter Haftung) being registered with the Commercial Register of the Canton of Zug, with its registered office at Zählerweg 12, 6300 Zug, Switzerland. UQG GmbH is attaining membership of a self-regulatory organisation (SRO) recognised by FINMA.

What SRO membership means

In Switzerland, financial intermediaries that are not banks must either be authorised directly by FINMA, the Swiss Financial Market Supervisory Authority, or join an SRO recognised by FINMA. The SRO sets binding rules on how its members meet their duties under the Swiss Anti-Money Laundering Act (AMLA), including client identification, beneficial-owner checks, transaction monitoring, record keeping and reporting to MROS, the Money Laundering Reporting Office Switzerland. The SRO audits its members regularly and can sanction them. FINMA recognises and supervises the SROs.

Anti-money laundering and sanctions

We take financial crime seriously. Our controls follow:

  • the Cyprus Prevention and Suppression of Money Laundering and Terrorist Financing Law of 2007 (Law 188(I)/2007), as amended, and the EU anti-money laundering directives it implements;
  • the Australian Anti-Money Laundering and Counter-Terrorism Financing Act 2006 and AUSTRAC's rules;
  • the Financial Action Task Force (FATF) standards, including the "travel rule" for transfers of digital assets; and
  • sanctions lists published by the United Nations, the European Union, the United Kingdom and the United States (OFAC).

In practice this means we verify every client's identity before opening an account (know your customer), ask about the source of funds where needed, screen clients and payments against sanctions lists, monitor activity, and report suspicious activity to the relevant authorities, including MOKAS (the Cyprus Unit for Combating Money Laundering) and AUSTRAC. We keep these records for at least five years after our relationship ends. We may delay, refuse or reverse a transaction, or close an account, where the law requires it.

Our partner institutions

uQualify is not a bank. Accounts and payment services are provided through regulated partner financial institutions, and we are connected to more than 120 financial institutions worldwide. Where we cannot serve a client directly, our coverage tool routes the application to a suitable partner, but only with the client's agreement. Crypto wallets are held privately by clients and are in the custody of an independent digital-asset custodian; UQG Ltd does not hold or have custody of clients' digital assets.

Data protection

UQG Ltd is the controller of your personal data and complies with the EU General Data Protection Regulation (GDPR) and the Cyprus Law 125(I)/2018 on the protection of natural persons with regard to the processing of personal data. Our supervisory authority is the Office of the Commissioner for Personal Data Protection in Cyprus. Read our privacy policy and cookie policy, or email privacy@uqualify.co.
